Real Estate

           Wiley Malehorn Sirota & Raynes has handled more than a billion dollars in commercial and residential real estate closings.  We provide guidance to clients ranging from commercial developers in complex land transactions to first time home buyers.   

           In addition to sales and purchases, our experience includes negotiating, preparing and reviewing leases of varying duration and complexity, handling real estate concerns for joint ventures and refinancing.   

Our experienced attorneys understand the multi-faceted elements of real estate transactions and are able to address corporate, environmental, bankruptcy and other matters that may arise.  We assist our clients in the resolution of real estate litigation, whether through mediation, arbitration or trial. 

We also represent lenders and borrowers in mortgage financing for real estate, including the preparation and review of loan documents.   

We also represent taxpayers in real estate assessment appeals and litigation.   

 Tax Appeals

We assist clients in obtaining fair valuations on their property.  In this time of increasing local property taxes we understand that landowners, particularly businesses can face dramatic increases due to reassessments and revaluations.  We advocate for landowners seeking to reduce their tax burden and lock in those savings for a statutory three year period.  

Zoning

           We represent homeowners, builders, developers and commercial entities before planning and zoning boards.  We also represent such boards.  This gives our firm a unique understanding of the approval process.  We will work with our clients and when necessary, professionals on their behalf, including planners, engineers, environmental professionals and traffic experts.  We use our knowledge and experience to find common ground among developers, environmentalists, neighbors and board members to obtain the desired approval.

Environmental

We counsel our clients as to the impact of environmental law on real estate and business matters, including disclosure obligations and environmental insurance issues.  We also prepare and review leases, agreements, mortgages and related documents to address environmental concerns.  We provide environmental compliance counseling for our clients to advise them on how to comply with applicable statutes and regulations.   

           We counsel numerous clients in their dealings with the NJDEP and EPA with respect to state and federal statutes and regulations, including ISRA, the New Jersey Spill Act, CERCLA, the Underground Storage Tank Act and the Spill Compensation Act.  We assist in the preparation of documents for the NJDEP or EPA, work to ensure that regulatory requirements are met and negotiate remediation agreements.
